Can I apply for compensation if I am at fault?

Yes, according to the law of the Province of Ontario, you can apply for Accident Benefits even if you were found at fault in the Motor Vehicle Accident. However you cannot pursue a Tort Claim for compensation if you are at fault.

Can I obtain compensation if the person who caused the Accident does not have insurance?

Yes you can. Your insurance company will pay your compensation. If you do not have your own insurance as well, the compensation will be paid by the Province of Ontario.
